MEXICO: Extension for NOM Certificates at Customs

Through the Secretary of Industry and Commerce, the General Directorate of Standards and the Directorate General of Foreign Trade (DGCE) of the Ministry of Economy (SE) inform by Note 312.2019.01.1363, dated May 15, 2019, in relation to the NOM certificate of compliance, that there is an agreement to modify the DOF issued on October 23, 2018.

The certification bodies must transmit the information to the Standard-Customs System in accordance with the DGN guidelines for this purpose.  This information will consist of:

• Certificate validity
• Equipment specifications
• Volume
• Tariff fraction

Likewise, in order for the customs clearance to be carried out, the certification body must transmit the information contained in the certificates to the Standard-Customs System, which will be mandatory as of June 3, 2019. But, taking into consideration the time it takes to evaluate the conformity of each of the NOMs, the Secretary of Economy considers it feasible to grant a deadline of 90 calendar days that expires on August 12/2019, so that, the equipment can be imported without demonstrating Customs compliance with the corresponding certification as long as the request to the certification body, testing and calibration laboratories or verification units have been entered before May 31, 2019.

For the purpose of the above, the certification bodies, test and calibration laboratories or verification units will issue the acknowledgment of receipt with the corresponding sheet that must be declared in the application. This acknowledgment of the folio must also be transmitted to the Standard-Customs System.
