MEXICO: IFT Publishes Conformity Assessment Procedure for Telecommunications and Broadcasting

On February 25th, IFT has published in the Official Gazette the Conformity Assessment Procedure For Telecommunications and Broadcasting that can be connected to the telecommunication network or make use of the radio spectrum, which are subject to the IFT technical provisions.

– Formats, Documents, user guides, and requirements should be provided in Spanish. Technical documents could be in English.
– The IFT website will be listed as the authorized Certification Bodies, Laboratories and/or Verification Units.
– The test reports should mention they have a validity of 60 days.

After the test report is received by the Certification Body, there is a deadline of 10 business days to issue the certificate, 2 more days to deliver it.

If a certificate is not issued, but any arise observances, there is a deadline of 3 business days to subside them.

– IFT should register all the conformity certificates or Non-conformity letters in its electronic database.
– In case the product does not pass the test, a second test could be done with a different sample, but no additional opportunities to retest.
– The conformity certificates are subject to the applicable maintenance inspections.
– When foreign test reports are accepted, they should be in Spanish.
– If a certificate is suspended, this should be published on the IFT website and the applicant will have until 20 business days to provide the respective clarifications.

It establishes the following certification schemes for the products:

I. Sample by Product Model for a single Lot. Permanent validity and the list of the serial numbers should be provided.
II.  Sample by Product Model and Surveillance for more than one Lot. The certificate has permanent validity. The certificate could be updated to include additional lots. The CB could do inspections in the sale-points or warehouses.
III.  Sample by Products Family and Surveillance.
First, family formation is defined by the CB. Then, Two models from a family must be tested (1 sample from each one). The certificate has a permanent validity and will have inspections in the sale-points or warehouses.
– Same brand and functionality, but only outside or esthetic differences.
– Same block diagram, proving that they have the same cards for the transceiver or radio transmitter, with the same arrangement of tracks, integrated circuits, components, antenna (s), frequency (s) and operating technology (s), among others, and the same functionalities intended for use with which they were built.
IV. Sample by Telecommunications or Broadcasting and Surveillance Device
It only allows the certification of telecommunications or broadcasting devices whose functionality is focused on the Internet of things (IoT) or short-range radio communication.

This Conformity Assessment Procedure will enter into force three hundred and sixty-five calendar days from its publication.

The Certificates of Compliance issued by the Certification Bodies prior to the entry into force of this ordinance will have all the legal effects of the Certificates of Conformity issued in terms of this Conformity Assessment Procedure for Telecommunications and Broadcasting. Likewise, said Certificates of Compliance will remain in force in the terms in which they were issued but they can not be extended.
